Terms of Service
These Terms explain what you're buying, how it's delivered, and what you can (and can't) do with it. Please read them before you order.
1. Who we are
Personalized Manifestations (“we”, “us”, “our”) operates the website personalizedmanifestation.com (the “Site”) and creates personalized audio recordings (each an “Audio”). You can reach us at hello@personalizedmanifestation.com.
2. Accepting these Terms
By using the Site or placing an order you agree to these Terms, to our Privacy Policy and to our Refund Policy, which are part of these Terms. If you don't agree, please don't use the Site or place an order.
You must be at least 18 years old and legally able to enter into a contract to make a purchase.
3. What you're buying
An order is a one-time purchase of a single Audio, created for you from the answers you give in our questionnaire (your name, your goal, how you want to feel, and the other details we ask for). The Audio is a digital product: nothing physical is shipped.
Every Audio is unique and is produced after you order. That's why it can't be returned or exchanged once it's made (see our Refund Policy).
4. Price and payment
- The price is shown at checkout in US dollars. Any promotional price is valid only while it's displayed and may change without notice.
- Payment is a single charge. There is no subscription and no recurring billing.
- Payments are processed by Stripe. Your card details go directly to Stripe; we never receive or store your full card number.
- Where taxes apply, they are either included in the displayed price or shown at checkout.
5. Delivery
- We aim to deliver your Audio within 24 hours of your purchase.
- It's delivered by email to the address you enter at checkout, as a private link where you can listen and download it. The same page is shown to you right after payment, so you can also refresh it to check.
- Emails sometimes land in spam or promotions folders. Please check there before contacting us.
- You're responsible for entering a correct, working email address. If you made a typo, email us as soon as possible.
- If you haven't received your Audio 24 hours after purchase, write to hello@personalizedmanifestation.com and we'll sort it out.
6. Your answers
You're responsible for what you write in the questionnaire. Please make sure your answers are accurate: the Audio is built directly from them.
Don't include personal information about other people, or anything unlawful, hateful, threatening, sexually explicit or that infringes someone else's rights. We may decline to produce an Audio that breaks these rules; if we do, we'll refund your payment in full.
We may lightly adapt the wording of your answers so the Audio flows naturally, without changing their meaning.
7. Your license and how you may use the Audio
Once you've paid, we grant you a personal, non-exclusive, non-transferable license to listen to, download and keep copies of your Audio for your own personal, non-commercial use, for as long as you like.
You may not sell, rent, redistribute, publicly perform or broadcast the Audio, upload it to streaming or file-sharing platforms, use it in any commercial product or service, remove any identifying marks, or claim it as your own work.
We (and our licensors) keep all intellectual property rights in the Site, the scripts, voices, music and production of every Audio. The personal information you gave us remains yours, and is handled as described in our Privacy Policy.
8. Not professional advice
The Site and the Audio are for personal development, relaxation and entertainment. They are not medical, psychological, therapeutic, financial or legal advice, and they are not a substitute for care from a qualified professional.
- If you have, or think you may have, a mental health condition, are pregnant, have epilepsy or a sleep disorder, or are under medical treatment, please talk to your doctor before listening.
- Never listen while driving, operating machinery or doing anything that requires your full attention.
- Results vary from person to person and are not guaranteed. Any testimonials or examples on the Site describe individual experiences only.
9. Refunds
Because each Audio is made to order, refunds are only available in the specific cases described in our Refund Policy, which is part of these Terms.
10. Emails from us
We'll email you about your order (payment confirmation and delivery). If you start an order and don't finish it, we may send you a single reminder. To stop any of these, reply to the email or write to hello@personalizedmanifestation.com.
11. Third-party services
We rely on third parties, such as Stripe for payments, to run the Site. Their services are governed by their own terms and policies, and we're not responsible for them.
12. Disclaimer of warranties
To the fullest extent permitted by law, the Site and the Audio are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose or that any particular outcome will be achieved. We don't promise that the Site will always be available or error-free.
13. Limitation of liability
To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Site or the Audio. Our total liability for any claim related to an order is limited to the amount you paid for that order.
Some jurisdictions don't allow certain limitations; in those places, these limits apply only as far as the law permits. Nothing in these Terms limits rights that consumer law gives you and that can't be waived.
14. Changes to the Site and to these Terms
We may change or discontinue parts of the Site at any time. We may also update these Terms; the current version is always at personalizedmanifestation.com/terms. Your order is governed by the Terms in force when you placed it.
15. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Personalized Manifestations is established, without regard to conflict-of-law rules, and subject to any mandatory consumer protection rules of the country where you live.
If you have a problem, please write to us first at hello@personalizedmanifestation.com: we'll try to resolve it informally within 30 days before either of us starts any formal proceeding.
